1) INDEMNIFICATIONS.
1.1 INDEMNIFICATIONS
BY CUSTOMER. Customer agrees to indemnify, defend and hold the Company,
its owners and employees, harmless from and against any and all losses,
claims, demands, damages, liabilities, costs and expenses, including but
not limited to reasonable attorney fees and costs of suit arising out
of our "Customer use of services provided to you by American Healthy Living
Such indemnification shall included, but not be limited to loss of data,
claims for libel, slander infringement of copyright, theft of misappropriation
of intellectual property, or unauthorized use of any trademark, trade
name, or service mark.
1.2 INDEMNIFICATION
BY American Healthy Living. Except as otherwise herein provided, American Healthy Living
agrees to indemnify, defend and hold Customer harmless from and against
any and all losses, claims, demands, damages, liabilities, costs of suit
(but excluding consequential damages) arising from our gross negligence
in the course of providing service under this agreement.
2) INTERRUPTIONS:
DISCONTINUANCES.
American Healthy Living is not, and will not, be responsible for interruptions
or discontinuances of service caused by factors beyond its control, including,
but not limited to equipment failure, delays, negligence, strikes, or
acts of God.
3) INFORMATION ACQUIRED
All information and contents thereof obtained using our services is the
sole responsibility of the customer. American Healthy Living, its owners or employees,
will not be held responsible for any damages you or another party suffer
as a result of our service. Transmission of any material in violation
of any U.S., state or local regulation is strictly prohibited.
4) CANCELING AND
RETURNS.
Return Policy Canceling. If you wish to cancel/return orders using our
website American Healthy Living, you are required to call us and get an authorization number.
Canceling does not relieve you of liability for any outstanding funds
due to American Healthy Living which covers 25% of the cost of package, included
within the processing fee, restocking fee (if applicable) and taxes. The
same applies to international orders. Return shipping will be paid by
the clients.
RETURNS. Once you
accept the package, you have 3 days to return it to us in its original
state; the seal should not be tampered with in any way. We will then credit
your credit card account, upon receiving the package, with full purchase
price less deductions, no questions asked. In instances that you used
the product. You have 7 days to return it to us, after this grace period,
we can no longer accept the product. If any problems occur and you believe
that the product(s) caused it, you have the same 7-day grace period and
the contents of the bottle should be 3/4 Full. The same holds true for
creams and lotions. We will not accept any returns in which the reason
for the return is something beyond our control such as mishandling and/or
misuse of product(s), tampering, etc.
SHIPPING CHARGES.
A 15% shipping charge will be deducted to the purchasers account for
all returns and exchanges, whatever the reason, to compensate American Healthy Living
for such expenses.
5) AMENDMENTS
These terms of service supersede all prior and contemporaneous agreements
or understandings, inducement or conditions, expressed or implied, between
American Healthy Living and the customer(s). American Healthy Living reserves the right
to change its rate and/or modify these Terms of Service as long as notice
is given via e-mail, at least 30 days in advance of the effective change.
6) ACCEPTANCE.
Use of products from American Healthy Living or 1 day after you received our products
package, constitutes, constitutes acceptance of current Terms of Service
and online polices of American Healthy Living.
7) DOMESTIC SHIPPING.*
if the delivery company
records that the package has been delivered, and
if a signature is not required, please note that we do not accept responsibility
if the package is lost or stolen.
Please note that We ship packages M-F only. There is no weekend delivery.
Please also note that our shipping cut off time is 3 PM EST. Any orders placed after
that will be processed on the following business day.
Please also note that we do not ship expedited shipping to PO Boxes.

Please also note that any customs duties must be paid by the client for international orders (orders outside of the United States). Please check with your customs office to find out your particular customs policies in your company.
